1. Products and Services

Certain products or services may be available exclusively online, through selected physical locations, or through The Nail Hub automated vending machines.

Products may be available in limited quantities. Availability is not guaranteed until an order or transaction has been successfully completed.

We make reasonable efforts to accurately display product photographs, colours, finishes, sizes and descriptions. However, the appearance of colours and finishes may vary depending on lighting, photography, and individual device or screen settings.

Hand-finished, printed and customised products may also display minor natural variations.

2. Prices and Modifications

Product and service prices may change from time to time without prior notice, subject to applicable law and confirmed transactions.

We reserve the right to introduce, modify, suspend or discontinue any product, design, collection, promotion, website feature or service at any time.

Where permitted by law, we will not be liable merely because a product or service has been modified, discontinued or is temporarily unavailable.

Changes will not affect rights already acquired under a confirmed transaction, except where permitted by applicable law.

3. Geographic Availability

Products and services may be restricted to particular geographic areas.

We reserve the right to limit or refuse sales or delivery to specific locations, including areas within the UAE, GCC or other territories that we may service from time to time.

4. Orders

We reserve the right, where reasonably necessary and permitted by law, to refuse, cancel or limit an order, including in cases of:

• Suspected fraud
• Payment failure
• Product unavailability
• Obvious pricing or technical errors
• Suspected resale or misuse
• Violation of these Terms
• Circumstances in which fulfilment is not reasonably possible

If we cancel an order after successfully receiving payment and no product has been supplied, the appropriate payment will be refunded.

5. Billing and Account Information

Customers agree to provide accurate, current and complete information when making a purchase. This includes billing details, delivery address, mobile number and email address.

We may use the contact information supplied during checkout to communicate regarding orders, payments, delivery or customer-service matters.

The Nail Hub is not responsible for delivery problems caused solely by inaccurate information supplied by the customer, subject to applicable law.

6. Payment

Online card payments are processed through Network International or another payment provider displayed at checkout.

Prices are displayed in UAE Dirhams (AED) unless otherwise stated.

Orders are subject to successful payment authorisation.

The Nail Hub does not independently store customers’ complete payment-card information. Card details are securely processed by the payment provider.

7. Delivery

Our designated courier partner is SkyNet. Another approved delivery provider may be used where operationally necessary.

Estimated delivery periods are estimates only and may be affected by circumstances outside our reasonable control.

Customers are responsible for providing accurate delivery information and ensuring that delivery can reasonably be completed at the supplied address.

8. Returns and Refunds

Purchases are subject to our separate Returns, Refunds & Exchange Policy, which forms part of these Terms.

Because press-on nails are personal-use hygiene products, change-of-mind returns and exchanges are generally not accepted.

This does not affect mandatory rights concerning defective, damaged, incomplete or incorrectly supplied goods.

9. Nail Sizing

Sizing guides are provided to assist customers in choosing the most appropriate fit.

Customers are responsible for measuring their nails and selecting their preferred size.

Individual nail shape, width and curvature may vary. Our sizing guide cannot guarantee an identical fit for every customer.

10. Vending Machines

Customers using The Nail Hub vending machines must check available selections before confirming a transaction.

If payment is successfully taken but no product is dispensed, an incorrect product is dispensed due to a machine malfunction, or another verified transaction error occurs, please contact hello@thesugarcloud.ae with the transaction details.

Customers must not strike, shake, tilt, climb on, open, interfere with or tamper with any vending machine.

Children should be appropriately supervised around automated equipment.

Damage caused deliberately or through unauthorised interference may be reported to the relevant authorities, and recovery of losses may be pursued where appropriate.

11. Customer-Uploaded Designs

Customers may have the opportunity to upload photographs, images, graphics or other material for personalised products.

By submitting content, you confirm that you own the content or have the necessary permission and rights to use it.

You must not submit material that:

• Infringes copyright, trademark or other intellectual-property rights
• Unlawfully violates another person’s privacy
• Contains unlawful, abusive, hateful or defamatory material
• Contains malicious code
• Otherwise violates applicable law

We reserve the right to reject inappropriate or potentially unlawful submissions.

12. Comments, Feedback and Suggestions

Where customers voluntarily submit reviews, comments, ideas, suggestions or other feedback, they grant us permission to use, reproduce, edit and publish that material for legitimate business and promotional purposes, subject to applicable privacy and intellectual-property laws.

This does not transfer ownership of customer-uploaded personalised nail artwork merely because it was submitted to fulfil an order.

13. Errors, Inaccuracies and Omissions

Our website may occasionally contain typographical errors, inaccurate information or omissions relating to product descriptions, pricing, promotions, delivery, availability or other information.

We reserve the right to correct errors and update information.

Where an error materially affects an existing customer order, it will be addressed in accordance with applicable UAE law.

14. Prohibited Uses

You must not use the website or services to:

• Engage in unlawful activity
• Encourage others to commit unlawful acts
• Violate applicable laws or regulations
• Infringe our intellectual property or the rights of others
• Upload malware, viruses or malicious code
• Attempt unauthorised access to our website or systems
• Scrape or collect personal information unlawfully
• Interfere with website security
• Impersonate another person
• Use our systems fraudulently

We may restrict or terminate access where these Terms are materially violated.

15. Intellectual Property

Unless otherwise indicated, The Nail Hub and The Sugar Cloud branding, logos, website content, photographs, graphics, designs, marketing materials and other original intellectual property are owned by or licensed to the relevant business.

They may not be reproduced, commercially exploited or used without appropriate permission, except where permitted by law.

16. Website Availability and Disclaimer

We aim to provide a reliable website and service but cannot guarantee that the website will operate uninterrupted or be completely free from technical errors.

The website or individual features may occasionally be unavailable due to maintenance, upgrades, network issues or circumstances outside our reasonable control.

Nothing in these Terms excludes warranties, obligations or rights that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, The Nail Hub, The Sugar Cloud and their respective owners, directors, employees, contractors and affiliates will not be responsible for losses arising solely from:

• Customer misuse of a product
• Failure to follow application, removal or care instructions
• Incorrect sizing selected by the customer
• Unauthorised alteration of products
• Improper use of vending equipment
• Deliberate tampering with vending machines
• Customer-submitted material infringing third-party rights
• Use of products for purposes for which they were not intended

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify The Nail Hub and The Sugar Cloud against reasonable claims, losses, liabilities or expenses arising directly from:

• Your unlawful misuse of the website or services
• Infringement of third-party rights through material you submit
• Material violation of these Terms

19. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary, and the remaining provisions will continue in full effect.

20. Termination

You may stop using our website at any time.

We may suspend or terminate access where a user materially violates these Terms, abuses our services, or engages in unlawful or fraudulent activity.

21. Entire Agreement

These Terms, together with our Returns, Refunds & Exchange Policy, Privacy Policy and any other policies displayed on the website, constitute the full agreement governing the use of our website services and transactions, subject always to applicable law.

22. Changes to These Terms

We may update these Terms from time to time.

The latest version will be published on this website with an updated revision date.

Changes will apply prospectively, except where otherwise permitted or required by law.

23. Governing Law

These Terms are governed by the applicable laws of the United Arab Emirates.

Nothing in these Terms limits mandatory consumer rights or remedies available under applicable UAE legislation.
